Drug and Alcohol Screening – Why do you need us?
In our ever more litigious corporate environment, creating and enforcing a strict policy on drugs in the workplace has much to offer the employer and employee:
Under the Health and Safety at Work Act 1974 there is a duty for companies to provide for the health, welfare and safety of all employees. From a substance misuse point of view, this would include having clear rules about coming to work under the influence of alcohol and/or drugs whether these are prescribed, over the counter or controlled substances. The rules should also cover alcohol or drug consumption while at work. This “duty of care” extends to both the individual members of staff and their colleagues. So a consistent and rigorously applied drugs policy creates a safer working environment for employees and their co-workers.
Employer culpability – In addition, companies can be held to account for any failure in policy or practice that leads to a fatality under the requirements of Corporate Manslaughter Act 2009 with the ever increasing number of personal injury claims, an independently enforced drug policy demonstrates due diligence on the part of the employer, especially in light of this Law.
Incorporating drug and alcohol screening into your existing health and safety practices shows employees that you are committed to their safety at the same time as providing the backup of independent quality assurance monitoring of your company policy.
